1. Definitions
This Terms & Conditions Contract is between a prospective tutor, herein after to be called the “Tutor”, and the owner of the website www.chinesetutorscentre.co.uk , herein after to be called "Mandamania", "we" or "us".
A Tutor is defined as a person(s) who approaches Mandamania either via verbal or written instruction and requests Mandamania to introduce the Tutor to a person of group of person requesting tuition in Mandarin Chinese, herein after to be called the ‘Student,' for the purpose of employment.
2. Services to the Tutor
Mandamania provides a promotion and introduction service for Mandarin Chinese native speakers looking to give private tuition (herein called the "Service"). When approached by a prospective Student and based on the tuition requirements, Mandamania will first contact selected Tutors by email or telephone to dicsuss the tuition need and the Tutor's availability . Only upon agreement from the Tutor, they will pass the contact details to the Student.
Mandamania endeavors to ensure, but does not guarantee, the suitability of any Student introduced by Mandamania to the Tutor. Suitability includes, but is not limited to, a Student character, honesty, reliability or professional capacity. Mandamania accepts no liability for any loss, damage, expense or compensation suffered or incurred of any nature by neither the Student not the Tutor, arising directly or indirectly from an act or omission by any Student introduced to the Tutor by Mandamania.
3. Services to the Student
There is no contract between the Student and Mandamania.
Upon request from the Student, Mandamania will introduce one or several Tutor to the Student based on the Students requirement as submitted via the website. Mandamania cannot garrantee that the Tutor is suitable to the Student's need. It is the Student's responsibility to discuss and agree with the Tutor the details of teaching before entering into a contractual arrangement with him or her.
Mandamania does not check the claims, including teaching experience and qualifications, that Tutors make during the registration and introduction process.
Mandamania accepts no liability for any loss, damage, expense or compensation suffered or incurred of any nature by neither the Student nor the Tutor, arising directly or indirectly from an act or omission by any Tutor introduced to the Student by Mandamania.
4. Liability
Mandamania will not be liable or responsible to the Tutor, the Student or any third person for any amount or kind of loss or damage that may result (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Service in any way.
5. Introduction Fee
For each new Student introduced and accepted by the Tutor, Mandamania will charge a one-off fee to the Tutor equal to the price of 2 hours tuition. For example, if the Tutor charges £15 an hour, the introduction fee will be £30. This is independent of the amount of tuition purchased by the Student and the length of the relation between Tutor and Student.
The Tutor holds full responsibility for informing Mandamania immediately upon accepting to provide tuition services to the Student whether the Student intends to engage a Tutor on a permanent or temporary basis. Unless specifically stated by the Tutor, a request for a permanent Student will be assumed by Mandamania, and the applicable fee will be charged to the Tutor.
6. Terms of payment
After an introduction, Mandamania will send an invoice to the Tutor for the introduction fee as defined in section 3. The full amount of the invoice will be payable within two weeks of the introduction.
Failure to pay may result in the immediate termination of the Tutor's registration with Mandamania and notification to the Student of the Tutor's breach of contract.
7. Refund Scheme
Mandamania operates a money-back refun policy.
If a Student accepted by a Tutor for tuition decides to terminate the Tutor's services before the Tutor can recover their introduction fee through tuition revenue, Mandamania will provide to the Tutor a refund of the difference between the introduction fee and the revenue earned from the Student, if all the following conditions listed below in this paragraph are met.
In other words, if Student terminates the tuition after only one hour tuition, then Mandamania will refund half of the introduction fee. If the Student terminates after two hours, then the Tutor will have recovered entirely the introduction fee and will not received any refund.
Refund conditions:
a) The Tutor notifies Mandamania within 2 business days of the Student's termination.
b) The Tutor paid Mandamania's introduction fee in full within 14 days of the invoice date.
c) The Tutor has not changed the Student's location of tuition, the hours originally agreed by the Student and Tutor or the original tuition description and has provided the Student.
d) The Tutor did not terminate the Student's tuition or the Student did not end the tuition due to unreasonable demands placed upon the Student by the Tutor or for reasons stated above in ‘c'.
8. Employment Contract & Client Responsibility
This contract is not an employement contract.
Mandamania holds no responsibility for the Tutor and Student's employment contract and such matters are to be arranged between Tutor and Student. Mandamania may provide a tutoring agreement template if required.
Mandamania is not liable for any losses, personal injury or death resulting from its negligence. The Tutor assumes full legal responsibility for his or her Tax and National Insurance deductions.
9. References
Mandamania may contact the Student to ask for feedback and references on his or her Tutor. Those references will not be disclosed withouth the written consent of the Tutor.
